12:40 - 2023/05/22

Brain death means brain failure, in brain death, blood supply to the brain is stopped and oxygen is not supplied to it. The brain loses all its functions and undergoes irreversible destruction. Although other organs such as the heart, liver, and kidneys are still functional after brain death, they will gradually fail over the next few days. A brain-dead patient does not speak, does not see, does not respond to any external excitation, and will not be able to breathe without the use of artificial respiration. Brain death in medical science is absolute death and this person will never come back to life.

The above question can be examined from several perspectives:

  1. The permission to organ donation the limbs of a person who has brain death and the related rulings?
  2. The permission to transplant a severed organ and the rulings related to it?

 first:

It is permissible to use the organs of the deceased in case of brain death and limb amputation, when it does not accelerate their death and termination of life. In this case, there is no problem if the said act is done with his prior permission, or if it is necessary to save the respectable life of that member.

Second:

After amputating a limb, it is permissible to transplant it to the body of a person in need. If the patient's body accepts this new organ, that new organ becomes subject to the person and is pure like his other organs.
